My husband and I have fostered our 2 boys for 16 months now. There is a hearing to terminate parental rights in 3 weeks. We are planning to adopt and I contacted my company about using intermittent FMLA. I was informed that FMLA can only be used within the first 12 months of placement. They do not distinguish between foster placement and adoption placement. My concern is that in most cases foster parents would not know that a child was eligible for adoption within the first 12 months of placement. It seems that FMLA has not taken into consideration the foster-to-adopt situation. Has anyone else dealt with this issue?
